Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you and The Pragmatist Foundation ("we," "us," or "our") governing your access to and use of Mudpuppy (the "Service"), including our websites, applications, APIs, and related AI tools. By accessing or using the Service, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be 18 years of age or older to use the Service. By using the Service, you represent that you are at least 18 and have the legal capacity to enter into these Terms.

2. Who We Are

Mudpuppy is operated by The Pragmatist Foundation, a United States organization. Hard EA (hardea.org) is a nonprofit initiative of The Pragmatist Foundation. Mudpuppy (rfab.ai) is operated by the same organization. References in these Terms to "the Service" mean the Mudpuppy website and tools you are using.

3. Service Description

Mudpuppy is a United States-based, strictly safe-for-work family AI tool website that provides, among other things:

  • Autonomous AI agents and productivity automation
  • Multi-model research, document processing, and related business tools
  • Image, video, recording, and other media production tools through third-party AI services
  • Household and family AI tools
  • A token-based billing system for AI service usage
  • Local and cloud storage for user content

We may add, change, or remove features at any time.

4. Account Registration

You must register (including via Google OAuth or other methods we offer) to access certain parts of the Service. You agree to:

  • Provide accurate information during registration
  • Maintain the security and confidentiality of your account
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access or security breach

5. Token Economy and Billing

Virtual Credits: Tokens are virtual credits required to access AI services. Token purchases are:

  • Final and Non-Refundable: All token purchases are final except as required by law
  • Variable Pricing: Different AI models consume different amounts of tokens
  • No Cash Value: Tokens have no monetary value and cannot be exchanged for cash
  • Service Dependent: Tokens are only usable within our Service
  • Free Grants: Free tokens are provided at our sole discretion and may be modified or discontinued

Payment Processing: Payments are processed by third-party payment providers. We do not store payment card information.

6. Acceptable Use — Safe for Work

Mudpuppy is a strictly safe-for-work family product. Content, prompts, uploads, and outputs must be suitable for children and for a shared family device. You may use the Service only for lawful, family-appropriate purposes.

You agree not to use The Pragmatist Foundation's Mudpuppy services to:

  • Create, upload, post, generate, email, transmit, request, or otherwise make available any adult, pornographic, erotic, sexually explicit, or otherwise not-safe-for-work content — including sexual chat, sexual roleplay, fetish content, sexual nudity, or sexually explicit images, audio, or video
  • Upload, post, email, transmit, or otherwise make available any Content that is unlawful (e.g., prostitution), harmful, threatening, abusive, harassing, tortious, defamatory, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
  • Violate any applicable local, state, national, or international law
  • Use the Service in any way that would be inappropriate for a child or on a shared family device
  • Attempt to bypass, jailbreak, or otherwise evade Mudpuppy's safe-for-work rules or a third-party AI provider's content restrictions
  • Infringe the intellectual property or other rights of others
  • Attempt unauthorized access to our systems or other user accounts
  • Reverse engineer, decompile, or extract source code except as permitted by law
  • Circumvent usage limits, rate limiting, billing, or security measures
  • Interfere with or disrupt the Service or any networks connected to the Service

We enforce this. We may remove content, disable models or features, suspend accounts, or terminate accounts immediately for any violation of this section, with or without notice.

7. Safe-for-Work Rules and Third-Party AI Provider Policies

Mudpuppy is operated as a safe-for-work service. Where these Terms are stricter than a third-party AI provider's policy, these Terms control for use of Mudpuppy.

The Service also runs on APIs and models provided by major AI companies. We follow the content restrictions of the AI providers whose APIs we use, and those providers handle enforcement of their own policies on traffic sent to them. You must comply with the acceptable use, content, and safety policies of every third-party AI provider you reach through the Service, including without limitation OpenAI, Anthropic, Google, xAI, Amazon, Mistral, and any other provider we add.

Those providers independently review, filter, block, or refuse prompts and outputs. We do not override a provider's content restrictions. A provider refusal, filter, or safety block is not a failure of the Service and is not a basis for a refund except as required by law.

8. Content and Intellectual Property

Your Content: You are responsible for all content you create, upload, or input into the Service, and you represent that you have the rights needed to use that content with the Service.

AI-Generated Content: Content generated by AI services is provided "as is" for your use. We make no claims about ownership or rights to AI-generated content beyond what is needed to operate the Service.

Service Content: All software, interfaces, and service materials are owned by us or our licensors and protected by intellectual property laws.

No Extra License: We do not claim ownership of your content and do not require a license beyond what is necessary for basic service operation (including transmitting your prompts to the AI providers you choose).

9. Third-Party AI Services

The Service relies on third-party AI providers, which may include:

  • Text generation: OpenAI, Anthropic, Google, Mistral, xAI, and others
  • Image and video generation: providers such as those we expose in-product (including ModelsLab, Replicate, Amazon Bedrock, and others)
  • Data sharing: Your prompts and related content are sent to the providers you use
  • Provider terms: Your use is also subject to each provider's terms of service and acceptable use policy
  • No control: We cannot control how those providers process, store, or use data once it is sent to them

10. Service Availability

We provide the Service "as is" and "as available." We do not guarantee:

  • Uninterrupted service availability
  • Error-free operation
  • Compatibility with all devices or browsers
  • Availability of any specific AI model or feature

We may modify, suspend, or discontinue the Service at any time with reasonable notice where practicable.

11. Account Termination

By Us: We may suspend or terminate your account immediately for violations of these Terms — including any not-safe-for-work use — as well as for illegal activity, abuse of the Service, or non-payment.

By You: You may delete your account through account settings. Upon termination, your data will be handled according to our Privacy Policy.

Effect of Termination: Unused tokens are forfeited upon account termination except as required by law.

12. Disclaimers and Limitations

No Warranties: The Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

AI Content Disclaimer: Mudpuppy is intended to produce family-appropriate output. AI-generated content may still be inaccurate or incomplete. Report any not-safe-for-work output. You are responsible for how you use generated content.

Limitation of Liability: To the maximum extent permitted by law, our liability is limited to the amount you paid for tokens in the 12 months preceding any claim.

No Consequential Damages: We are not liable for indirect, incidental, special, or consequential damages.

13. Indemnification

You agree to indemnify and hold The Pragmatist Foundation and its officers, directors, employees, and agents harmless from claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights or any third-party AI provider's policies
  • Content you create, upload, or share through the Service

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Delaware, except where applicable law requires otherwise.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the Service or by email where we have an address for you. Continued use after changes constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
